HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITON No. 39359 of 2018 O R D E R:

When the matter is taken up, the written instructions dated 12.11.2018 furnished by the respondent No.3-Sub Inspector of Police, SR Nagar Police Station, are placed on record by the learned Government Pleader. The said instructions read as under: " On a complaint lodged by the petitioner with the police of SR Nagar Police Station, a petty case vide Consecutive No.HYD/61PC1810 1944/2018 dated 11.07.2018 U/sec.70(B) of City Police Act and Sec.323 IPC against Mr.P.Gyneswara Rao and others and after completion of the investigation, petty case charge sheet was also filed before the Hon'ble court of X Special metropolitan Magistrate at Hyderabad and the same was taken on file vide STC No.6756/2018.

The accused Mr.P.Gyneswara Rao contested the matter. Similarly, on the very same day on a complaint Mr.P.Gyneswara Rao lodged with the police of Sr Nagar Police Station, Hyderabad, a petty case vide Consecutive No.HYD/61PC1810 1944/2018 dated 11.07.2018 U/sec.70(B) of City Police Act and Sec.323 IPC against the petitioner herein.

The petitioner herein also contested the matter. It is pertinent to submit that action was taken on the complaint of the petitioner by way of booking a petty case against Mr.P.Gyneswara Rao and others under the provisions of Sec.70(b) of City Police Act and Sec.323 IPC and also on the compliant of Mr.P.Gyneswara Rao, a petty case under the provisions of Sec.70 (b) of City Police Act and Sec.323 IPC was registered against the petitioner herein.

Both the parties are contested the matter before the trial court."

AVSS, J WP_39359_2018 22.11.2018 Having regard to the facts and circumstances of the case and considering the submissions made by both the counsel, this Court deems it appropriate to dispose of the writ petition by placing the said written instructions on record. No costs.

Miscellaneous Petitions, if any, pending in this writ Petition shall stand closed.
