M/S Sri Laxmi Ganapathi Kirana And Jaggery Merchant, v. The State Of Telangana,

THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.24755 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents in harassing by interfering with the business of the petitioner in black jaggery and alum under valid licence and also seizing the jaggery and alum even though on production of bills and way bills evidencing that it was purchased under bills and transported under way bills and not allowing the petitioner to carry on business in black jaggery and alum, as illegal and arbitrary and without any authority of Law and consequently direct the respondents not to interfere or in any manner seize the stocks."

Heard Sri Babuji Tenneti, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court. Today, when the matter is called, written instructions, dated 12-08-2015 furnished by the Sub-Inspector of Police, Suryapet Town Police Station, Nalgonda District have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

"At the outset it is submitted that the petitioner was involved in Cr.No.365/2014 dated: 18.11.2014 on the file of Suryapet Town police station, The case is pending trial vide C.C.No.525/2015 before the Hon'ble Judicial First Class Magistrate, Suryapet, Nalgonda District.

It is respectfully submitted that the contention of the petitioner that the 3rd respondent police harassed, interfered with the business of the petitioner in black jaggery and alum and seized the jaggery and alum and not allowed to carry on business is false, hence denied. It is submitted that this respondent has never interfered in lawful business of the petitioner in black jaggery and alum.

It is incorrect to say that this respondent visited the

petitioner's business, threatened the petitioner to stop the business of purchase, sale of black jaggery and alum or else the petitioner will be implicated in false cases, hence denied. All the other allegations made against the official respondents herein are false, baseless and hence the same are hereby denied. Hence the writ petition deserves no consideration and liable to be dismissed."

On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and dispose of the writ petition. In view of the above, the writ petition stands disposed of, by recording the written instructions, 12-08-2015 furnished by the Sub-Inspector of Police, Suryapet Town Police Station, Nalgonda District.
