This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.176 of of Nellikudur Police Station,

Mahabubabad District, registered for the offences punishable under Section 103 of Bharaitya Nyaya Sanhita, 2023. 2.

The facts of the case are that on 03.10.2025, the complainant lodged a complaint before police stating that about 20 years ago, the complainant's younger sister, Cheekati Swapna was married to the petitioner herein. The couple had two sons Cheekati Vikram and Cheekati Varun Sandesh. In recent times, Vikram had developed a habit of consuming alcohol and often created disturbances at home. On the previous day, during the Dussehra festival, Vikram had a party with his friends, consumed alcohol, and returned home late at night. This led to a quarrel between the deceased-Swapna and her husband-petitioner herein. On 03.10.2025 at about 12:30 PM, petitioner scolded his elder son Vikram for his behavior for which the deceased intervened and asked her husband not to reprimand their son. Enraged by her response that she is supporting their elder son, petitioner in a fit of anger, picked up an axe from the house and attacked Swapna, striking her on the right shoulder, back, and right side of her neck. As a result, she sustained severe injuries and died on the spot. Hence, complainant

requested the police to take action against the accused. Basing on the said complaint, police registered the case against the accused for the above offence.

Heard Sri R. Prashanth, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations and he is in jail from 04.10.2025 and even after lapse of 90 days charge sheet is not filed by the police. As such, petitioner is entitled for mandatory bail and prayed to grant regular bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail by filing counter stating that there are serious allegations against the petitioner. The offence alleged against the petitioner is under Section 103 of BNS which is severe in nature and there are eye witnesses to the incident in whose presence the petitioner killed the deceased. However, he informed the Court that charge sheet is not filed till today.

Therefore petitioner is not entitled for bail and prayed to dismiss this criminal petition.

Considering the submissions made by both the learned counsel and a perusal of the material available on record, petitioner is in jail from 04.10.2025 and even today no charge sheet is filed by the police even after completion of mandatory period of 90 days. Considering the same, this Court deems it fit to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner-Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of learned Judicial First Class Magistrate at Thorrur.

ii.

The petitioner-Accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner-Accused shall abide by the conditions stipulated in Section 480(3) of the BNSS.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
