This writ petition is filed for a writ of mandamus declaring the permission granted by the 2nd respondent under provisional clearance proceedings vide proceedings No.7879/13/G3 dated 24.07.2014 in favour of the 3rd respondent for construction of ground based monopole tower at the premises bearing Door No.26-44-68/1, of Venkataramana Colony, Guntur as illegal, arbitrary and contrary to G.O.Ms.No.380 MA dated 01.08.2013 and for a consequential direction to set aside the same. The case of the petitioner is that the 3rd respondent is constructing ground base monopole tower (GBM) at the premises bearing Door No.2644-68/1 of Venkataramana Colony, Guntur, which is a residential colony, and the said construction is in violation of the conditions prescribed in G.O.Ms.No.380 MA dated 01.08.2013. Aggrieved by the same, the present writ petition is filed.

Today, when the matter is taken up for hearing, Sri J.N.Bhushan, learned counsel appearing for the 3rd respondent, while submitting that the 3rd respondent is not constructing monopole tower in the said location as stated by the petitioner, produced proceedings dated 12.01.2015, issued by Guntur Municipal Corporation showing the location of construction at Door No.76, Venkataramana Colony, Guntur. Recording the above said submission, this writ petition is closed.
