HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.28302 of 2016 ORDER:

Petitioner challenges proceedings in D.Dis (C1) 133/2016 dated 20.04.2016 issued by the 2nd respondent and the consequential proceedings in Roc.A.327/2016 dated 09.08.2016 issued by the 4th respondent.

A perusal of proceedings dated 20.04.2016 reflects that the objections available to the petitioner are not adverted to. Hence, the proceedings dated 20.04.2016 and the consequential proceedings dated 09.08.2016 are set aside. The 2nd respondent-Joint Collector is directed to dispose of the appeal preferred by the 5th respondent. It is made clear the 2nd respondent considers each one of the objections and passes an order on merits. Till disposal of the appeal, interim order granted on 23.08.2016 shall remain in operation.

Writ Petition is accordingly ordered.
