THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.45408 OF 2016 ORDER:

This writ petition is filed challenging the action of the second respondent in not providing police protection to the petitioner in respect of residential plot bearing No.105 situated in Ground Floor of Anuradha Residency, Block No.C on plot Nos.8, 9 and 10 in survey No.117, situated at Medipally Village and Grampanchayat, Ghatkesar Mandal, Ranga Reddy District. The petitioner lodged a complaint, dated 02.12.2016, with the second respondent alleging interference of the third respondent and seeking police protection. A counter affidavit is filed by the second respondent admitting lodging of the said complaint and also making an entry in the Station General Diary and assuring further action after conducting enquiry.

However, it is stated that the preliminary enquiry revealed that the dispute between the petitioner and the third respondent, is purely civil in nature. It is also stated that unless and until there are specific directions to the respondent police to provide police protection to the suit schedule plot of the petitioner, it is difficult for the police to provide police protection. It is also stated that they are ready to provide police protection as and when there is any specific direction to do so. In the circumstances, this writ petition is disposed of giving liberty to the petitioner to submit written representation or by telephonic communication to approach the police as and when there is actual threat and the second respondent shall provide necessary protection on the petitioner approaching them.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 11.04.2017 pln
