HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27298 OF 2016 ORDER:
This writ petition is filed by the 3rd respondent in WP.No.13005 of 2016 declaring the notice dated 30.07.2016 vide RC.No.A3/160/2016, which was issued intimating the date and time of demarcation of Survey Nos.136 & 137 of Mulkala Village, without considering the objections raised by the petitioner, as illegal and seeks direction to the 3rd respondent not to conduct the survey.
Learned counsel for the petitioner submits that though survey was conducted earlier and petitioner submitted his objections on 12.05.2016 to the notice dated 05.05.2016 again the 3rd respondent issued the impugned notice for conducting survey. It is also stated that the 6th respondent also filed civil suit in OS.No.6 of 2016 on the file of the Prl.Senior Civil Judge, Mancherial and that in view of the same there is no need to conduct survey in pursuance of notice dated 30.07.2016. Since no notice was issued to the petitioner in WP.No.13005 of 2016 the same was allowed. As the learned Assistant Government Pleader states that objections of the petitioner would be considered at the time of conducting survey, it is for the petitioner to press the objections at the time of conducting survey in pursuance to the notice dated 30.07.2016 and the 3rd respondent shall consider the objections of the petitioner before proceeding to conduct survey in respect of the subject land which is the subject matter of notice dated 30.07.2016 in
Rc.No.A3/160/2016 and take action accordingly within a period of four weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
