THE HON'BLE SRI JUSTICE R.SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.32421 of 2015 ORDER: (Per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed with the prayer, which reads as under: "...this Hon'ble Court may be pleased to issue a Writ in the nature of a Mandamus or any other appropriate Writ, Order or Direction, directing the Respondent No.3 herein not to pass any orders or proceed with further on any application or execution proceedings that may be filed or initiated against orders in Consumer Complaint No.192/2015 dated 01.09.2015 pending disposal of FA.No.168 of 2015 on the file of the 2nd respondent and pass such other order or orders this Hon'ble court deems fit and proper in the circumstances of the case." While issuing notice before admission, this Court, on 06.10.2015, granted interim orders.
Against the order, dated 01.09.2015, in Consumer Complaint No.192 of 2015 passed by the District Consumer Disputes Redressal Forum at Karimnagar, an appeal in F.A.No.168 of 2015 is filed before the 2nd respondent - State Consumer Disputes Redressal Commission. As the 2nd respondent - Commission was not functioning due to non-appointment of the President, the petitioners have approached this Court.
When the matter is called for hearing, it is stated that the 2nd respondent - Commission is now functioning in view of the appointment of President and, as such, requested to dispose of the writ petition permitting the petitioners to pursue the appeal in F.A.No.168 of 2015 pending before the 2nd respondent. In view of the above, this writ petition is disposed of permitting the
petitioners to pursue the appeal in F.A.No.168 of 2015 and interlocutory applications, if any filed therein, before the 2nd respondent. Interim order granted by this Court shall continue for a period of four weeks from today.
Subject to the above, the Writ Petition is disposed of. No order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
