THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5260 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioner/owner of Eicher Van bearing Regd.No.AP-15-TB-4018 seeking to modify the order passed by respondent No.2 in Notice in Crime No.152/2015/P&Ex/A3, dated 21.3.2016, and to release the said vehicle by accepting third party surety for Rs.2,15,000/- instead of bank guarantee.

2. Heard and perused the material available on record.

3. Vide impugned order, the petitioner was directed to submit F.D.R. for Rs.2,15,000/- issued by any nationalized bank in favour of the Deputy Commissioner of Prohibition and Excise, Karimnagar and also to execute a bond with two sureties with an undertaking not to alienate/transfer/sale and to produce the vehicle as and when required by the Deputy Commissioner in the same condition. Seeking modification of the order to the extent of submission of F.D.R. for Rs.2,15,000/- issued by any nationalised bank, the present petition is filed.

4. Considering the facts and circumstances of the case, the petitioner is directed to submit F.D.R. for Rs.1,00,000/- (Rupees one lakh only) issued by any nationalised bank in favour of the Deputy Commissioner of Prohibition and Excise, Karimnagar instead of Rs.2,15,000/-.

5. With the above modification, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
