The writ petition is filed apprehending the appointment of third respondent as fair price shop dealer on compassionate ground in the vacancy caused by the death of her husband.

Now, the third respondent herself is 66 years old and therefore, she cannot be appointed on behalf of her husband on compassionate ground. In that view of the matter, the apprehension of the petitioner is without any basis. Accordingly, the writ petition is dismissed. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. ______________________________ A.
