Pasumarthi Dhanalakshmi, v. Korsa Abraham Donald,
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.35872 of 2017 ORDER:
Heard the learned counsel for petitioner, Sri S.Madhan Mohan Rao, learned counsel for 1st respondent and the learned Government Pleader for Revenue appearing for respondent Nos.2 to 5. 2.
Petitioner's grievance is that he preferred a Revision under Section 4A of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977 before the 4th respondent challenging the proceedings dt.23-09-2017 and 07-11-2016 of the 2nd respondent on 10-10-2017; that he has also filed an application for stay of the impugned orders before the 4th respondent, but the 4th respondent has not passed any interim orders thereon and in the meantime, there is a threat of dispossession of the petitioner.
3.
Though learned counsel for 1st respondent strongly opposed grant of any order in favour of petitioner, if no stay of the impugned orders challenged before the 4th respondent is granted pending disposal of the Revision by 4th respondent, the Revision itself might become infructuous.
4.
Therefore, the Writ Petition is allowed and the 4th respondent is directed to decide the Revision petition filed on 10-10-2017 by petitioner before the 4th respondent within three (03) months from the date of receipt of a copy of the order and till such Revision is decided,
MSR,J W.P.No.35872 of 2017 there shall be stay of the orders of 2nd respondent referred to above, which are subject matter of the said Revision. No costs. 5.
As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
