THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI Writ Petition No.39440 of 2018 ORDER:

This writ petition is filed seeking a writ of mandamus declaring the action of the respondents in not providing compassionate appointment to the petitioner under compassionate scheme in view of the death of her husband while in service on 18.07.2018 as Office Subordinate inspite of making representations to the respondents on 09.10.2018 and 10.10.2018 and sought a consequential direction to the respondents to appoint the petitioner under compassionate scheme.

Heard Sri P.V.Ramana, learned counsel for the petitioner and learned Government Pleader for Cooperation.

It has been contended by the petitioner that her husband was employed with respondents 3 and 4 and while discharging his duties, he has expired on 18.07.2018. Thereafter, the petitioner has submitted representations on 09.10.2018 and 10.10.2018 requesting the respondents to appoint her on compassionate grounds but the respondents have not passed any orders on the said representations. Learned counsel for the petitioner contends that there is a scheme in vogue to provide appointment on compassionate grounds but the respondents are deliberately and arbitrarily not considering the case of the petitioner.

Learned Government Pleader for Cooperation submits that the petitioner's representations for compassionate appointment will be considered in accordance with law.

This Court, having considered the submissions made by the parties, is of the view that this writ petition can be disposed of directing the respondents to consider the representations submitted

by the petitioner on 09.10.2018 and 10.10.2018 and pass appropriate orders within four weeks from the date of receipt of a copy of a this order.

With these observations, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
