Heard the counsel for petitioners, and the learned Government Pleader for Revenue, for respondents.

The petitioners have filed this Writ Petition alleging that the 2nd respondent is refusing to receive documents presented for registration by them without assigning any reason.

It is the statutory duty of 2nd respondent to receive documents presented to him for registration, and he cannot refuse to receive documents presented to him for registration. However, if he does not wish to register the said documents, it is always open to him to pass an order under Section 71 of the Indian Stamp Act, 1899, giving reasons why he does not wish to register the said documents. 4.
Accordingly, the 2nd respondent is directed to receive documents presented by petitioners for the purpose of registration; consider the same, and if he does not wish to register it, pass orders under Section 71 of the Indian Stamp Act, 1899 giving reasons why he does not wish to register them.

Accordingly, the Writ Petition is disposed of with the above directions. No order as to costs.
