HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 18020 of 2016 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Home.

The present writ petition is filed with the following prayer: "Issue a writ of mandamus declaring the action of respondent Nos.2 and 3 in not acting on the petitioner's complaints dated 26.05.2016 and 31.05.2016, as arbitrary, malafide, illegal and in violation of Sections 149 and 154 Cr.P.C."

Though various grounds are raised in the writ petition, learned counsel for the petitioner submits that though his report dated 31.05.2016 discloses commission of offence, the respondent police are not registering any crime. The same is opposed by the Government Pleader for Home. He submits that the allegations in the report do not disclose the commission of cognizable offence and that the dispute is purely civil in nature. Having regards to the facts in issue, the Station House Officer, Punjagutta Police Station shall proceed in accordance with law laid down by the Apex Court in LALITA KUMARI V/s. GOVERNMENT OF UTTAR PRADESH[1], if the allegations made in the report dated 31.05.2016 discloses commission of any cognizable offence.

With the above direction, the writ petition is disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
