THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI Writ Petition No.39451 of 2018 ORDER:
This writ petition is filed seeking a writ of mandamus declaring the action of the respondents in not providing compassionate appointment to the 2nd petitioner under compassionate scheme in view of the death of the 1st petitioner's husband on 28.09.2017 in the capacity of Office Subordinate inspite of making representations to all the respondents on 17.10.2017 and 10.10.2018 and sought a consequential direction to the respondents to appoint the 2nd petitioner under compassionate scheme.
Heard Sri P.V.Ramana, learned counsel for the petitioners and learned Government Pleader for Cooperation.
It has been contended by the 1st petitioner that her husband was employed with the respondents and while discharging his duties he has expired on 28.09.2017. Thereafter, the petitioners have submitted a representation on 17.10.2017 and 10.10.2018 requesting the respondents to appoint the 2nd petitioner, who is the son of the 1st petitioner and the deceased-employee, on compassionate grounds but the respondents have not passed any orders on the said representations.
Learned counsel for the petitioners contends that there is a scheme in vogue to provide appointment on compassionate grounds but the respondents are deliberately and arbitrarily not considering the case of the petitioners.
Learned Government Pleader for Cooperation submits that the petitioners' representations for compassionate appointment will be considered in accordance with law.
This Court, having considered the submissions made by the parties, is of the view that this writ petition can be disposed of directing the respondents to consider the representations submitted by the petitioners on 17.10.2017 and 10.10.2018 and pass appropriate orders within four weeks from the date of receipt of a copy of a this order.
With these observations, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
