The grievance of the petitioners, in which this Court finds legitimacy, is that their application bearing file No.64566, dated 29-07-2013, for building permission in their respective plots situated in House No.1-10-27/5/7, Begumpet, Hyderabad, is kept pending without being disposed of by

respondent No.2 and its functionaries.

Mr.Chatla Madhu, learned Standing Counsel for respondent No.2- Greater Hyderabad Municipal Corporation, candidly, admitted that the petitioners' application for building permission is pending and that as, in the opinion of respondent No.2, the plots, in respect of which the petitioners made application for building permission, belong to the Government as per the Register of Town Survey and Land Records, building permission has not been granted.

In my opinion, respondent No.2 is wholly unjustified in sitting over the petitioners' application for building permission. Irrespective of whether its perception about the ownership of the subject land is right or wrong, respondent No.2 is bound to consider the application made for building permission, take a decision thereon within a reasonable time and communicate the same to the parties so that, in the event an adverse decision is taken, the petitioners will be entitled to take recourse to the available legal remedies.

Therefore, respondent No.2 is directed to forthwith

take a decision on the petitioners' application for building permission and communicate the same to them within two months from the date of receipt of this order.

Subject to the above direction, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.54269 of 2015, filed by the petitioners for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 28th December, 2015 LUR
