THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.39380 of 2018 ORDER:

Heard learned counsel for the petitioners and the learned Government Pleader for Home, apart from perusing the entire material available on record.

When the matter is taken up, written instructions, dated 05.11.2018, furnished by the Sub Inspector of Police, Rajendranagar Police Station, Cyberabad, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, are as under:

"The facts of the case are that one Smt.C.R.Chandra Prabha lodged a complaint on 13.11.2017 with the respondent No.3-Station House Officer, Rajendranagar Police Station, Cyberabad stating that some unknown persons trespassed into the land under plot No.C-229 and 230 under Sy.Nos.96/2 and 96/3, admeasuring 600 sq.yards situated at Bandlaguda Jagir village and Gram Panchayat, Rajendranagar Mandal, Ranga Reddy District and threatened with dire consequences and basing on the said complaint, a case was registered in Cr.No.2364/2017, dated 13.11.2017 for the offences u/s 447, 427 IPC against the unknown persons on the file of the third respondent and investigation has been taken up.

It is further submitted that the said Smt.C.R.Chandra Prabha lodged a similar complaint on 26.10.2018 with the third respondent and a case was registered in Cr.N9;1622/2018 on 26.10.2018 for the offences u/s 447 and 427 IPC and that except registering the FIRs with regard to the above said lands, the third respondent or staff did not harass or

interfere with the said lands at any point of time and that it is incorrect to say that on 29.10.2018 the staff of the third respondent along with the fourth respondent came to the said land and directed the petitioners to stop the construction work and further directed to appear before the third respondent-police station".

By placing on record the above written instructions Writ Petition is disposed of, directing the respondent-police authorities to act strictly in accordance with law. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
