HON'BLE SRI JUSTICE R. SUBHASH REDDY CIVIL REVISION PETITION No.102 of 2015 ORDER :
This civil revision petition is filed under Article 227 of the Constitution of India, aggrieved by order dated 27.11.2014, in C.M.A.No.10 of 2014 on the file of XVAdditional District Judge, Krishna, confirming the order dated 15.03.2014, passed by the Junior Civil Judge, Mylavaram in I.A.No.89 of 2014 in O.S.No.113 of 2010. The suit in O.S.No.113 of 2010 is filed for partition and separate possession. Petitioner, claiming to be the half share holder in the 1/3rd share of his father, has filed an application in I.A.No.89 of 2014 for injunction and the same was dismissed with reasons and it was further confirmed by impugned order dated 27.11.2014 passed in C.M.A.No.10 of 2014.
In this revision, it is admitted by the learned counsel for petitioner that the petitioner is a co-owner, in which event, no injunction can be granted against the other coowner. In that view of the matter and in view of the concurrent findings recorded by the trial Court as well as the lower appellate Court, I do not find any ground to interfere with the impugned order.
The revision is accordingly dismissed. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
