THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6619 OF 2016 ORDER:
This Criminal Petition is filed by A.1 to A.4 seeking to quash the proceedings in C.C.No.81 of 2014 on the file of Judicial First Class Magistrate, Kanigiri, Prakasam District for the offences under Sections 498-A, 365, 506 IPC and Sections 3 & 4 of Dowry Prohibition Act.
Heard and perused the material on record.
After arguing for some time, since this Court is not inclined to quash the impugned proceedings at the threshold, the learned counsel for the petitioner submitted that Non-Bailable Warrants are pending against the petitioners and prayed to recall the warrants issued by the trial Court against the petitioners. In the circumstances, the petitioners are directed to surrender before the Court below and file an application seeking to recall the warrants. On filing such application, the Court below is directed to recall the Warrants issued against the petitioners on the same day on each of them executing a personal bond for a sum of Rs.5,000/- with one surety for the likesum for their future appearance.
