The petitioners state that they are in possession and enjoyment of the house sites situated at V. Venkatayapalem village, Raghunadapalem Mandal of Khammam District. The plots are situated in Survey Nos.240/E1, 242/E and 242/AA. They were purchased by the petitioners under registered sale deeds. They are all retired employees. While so, a notification was issued under the Act 30 of 2013 on 25.09.2017 to acquire the said sites along with other lands. The petitioners have right to file their objections under Section 15 of the Act, but the learned counsel for the petitioners submits that without waiting for filing objections and consideration of the objections, the respondents are going to take forcible possession of the property without publishing a declaration under Section 19 of the Act.

In the circumstances, in view of the right of the petitioners to raise objections under Section 15 of the Act, the respondents are restrained from taking possession of the property till a declaration is published and due process of law is followed. The petitioners are given liberty to file their comprehensive objections and the respondents are directed to consider their objections in accordance with law. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
