It is represented by Sri J.Prabhakar, Learned counsel for the petitioners, Learned Government Pleader for Finance and Planning for the respondents 1 to 3 as well as learned Government Pleader for Irrigation & Command Area Development for respondents 4 to 7 that the lis in this writ petition is squarely covered by the orders passed by this Court on 03.07.2012 in W.P.No.16787 of 2012.

Following the same and for the reasons alike in the order dated 03.07.2012 in W.P.No.16787 of 2012, it is hereby declared that the deduction of excess amount of Rs.28,10,470/- towards interest on mobilization advance given to the petitioner with reference to the interpretation of Government Memo No.1404/Reforms/A1/2010 dated 27.09.2010 submitted by the petitioner is declared as illegal and arbitrary and the petitioner is declared to be entitled to the payment of the said amount from the respondents and the petitioner is at liberty to pursue any remedies available

to him under law in support of any claim for interest, for any delay, over such amount before a competent Civil Court, if he so desires and is so advised.

Accordingly, the writ petition is allowed. There shall be no order as to costs.
