THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.M.P.No.2683 of 2015 in Crl.P.No.16151 of 2014 and Crl.P.No.16151 of 2014 Common Order:

The de-facto complainant and his counsel Sri Rupendra Mahendra are present. Accused No.1 and his counsel Sri T. Subash Reddy present. Heard both sides.

On the report of de facto complainant, the Police of Sultan Bazar Police Station, Hyderabad, registered FIR No.99 of 2014 for the offence under Sections 498(A), 420, 120(B) and 506 IPC and Section 3 and 4 of Dowry Prohibition Act and the investigation is reported to be pending.

While so, today the parties and their counsel present in Court and submitted that at the intervention of elders, they have amicably resolved the disputes and as per the terms of the Agreement, the de facto complainant and A.1 proposed to obtain divorce and the maintenance claim of the de facto complainant is concerned, A.1 agreed to pay Rs.9,00,000/- to her and out of the said amount, he already paid Rs.4,00,000/- and will pay the remaining amount at the time of obtaining divorce and as such, the de facto complainant has no objection for quashment of the proceedings in Crime No. 99 of 2014 and therefore, this Court may record the compromise and quash the criminal proceedings in the interest of justice.

In view of the above submission and as the matter is a matrimonial dispute which was amicably resolved by the parties, and no useful purpose will be served even if the investigation is ordered to be continued since the parties compromised the issue and following the decision of Hon'ble Apex Court in Gian Singh v. State of Punjab and another (2012) 10 SCC 303), Crl.M.P.No.2683 of 2015 is allowed and permission is accorded to compromise the case. Consequently, the Criminal Petition is allowed and the Proceedings in Crime No. 99 of 2014 on the file of Sultan Bazar Station, Hyderabad, are quashed in respect of A.1, as per the Compromise Memo filed by the parties.
