HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39521 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 2nd respondent in not taking action against the illegal occupation of the public road and thereby causing hardship in free flowing of the free public and drainage situated at Lakshminagar colony, Mahaboob Nagar, basing on the complaint made by the petitioner on 28.10.2018, as illegal and arbitrary. Though various grounds are raised, the learned counsel for the petitioner submits that though the petitioner submitted a complaint/representation on 28.10.2018 to the 2nd respondentCommissioner, requesting to remove the stones which were fixed by one Koppula Srinu and his men, by encroaching to the west side of the house of the petitioner's plot's road and thereby causing very much inconvenience to the petitioner from proceeding through the road and going to construct a house on the road situated at Sy.Nos.253 and 254 of Lakshminagar Colony, Mahaboob Nagar District, no action has been taken so far.
Learned Standing Counsel for the 2nd respondent, would submit that if the representation/complaint of the petitioner is still pending consideration, the 2nd respondent may be directed to pass appropriate orders, in accordance with law.
Since, the writ petition is going to be disposed of without going into the merits of the case, no notices are required to be issued to the unofficial respondents.
Having regard to the above, the writ petition is disposed of directing the 2nd respondent, to deal with the complaint/representation dated 28.10.2018, submitted by the
petitioner seeking removal of the stones which were planted as stated above and pass appropriate orders, in accordance with law, as early as possible, preferably within a period of four to six weeks from the date of receipt of copy of the order, after hearing all concerned. No order as to costs.
As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
