The case of the petitioner is that petitioner-company purchased land of an extent of Ac.22-00 cents in R.S.NO.60-P of of Jaffapuram Village, Saidapuram Mandal in Nellore under two registered sale deeds bearing document Nos. 47 and 48 of 2006 dated 27-02-2006 from Sk.Mohammed Gouse and Sahaik Hafiza Begum, Sk.Khadir Basha, Sk.Abdul Rahman and Kanumalla Venkata Subba Rao for valuable consideration. The Special Deputy Tahsildar (Inams) Nellore had issued ryotwari patta in respect of their shares in the year 1979. Pattadar passbooks were also issued to the vendors of the petitioner in respect of share of their land. The petitioner made application for mutation and issuance of pattadar passbooks in respect of above said land on 11-03-2016. As no orders are passed, the present writ petition is filed.
Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.
Learned Assistant Government Pleader basing on instructions submits that in respect of subject lands, D-form pattas were granted and the subject lands were already resumed from the persons to whom, it has been assigned on 01-101992. As such, application of the petitioner cannot be considered. All these aspects have to be considered by the 2nd respondent while disposing of the application filed by the petitioner. This Court is not going into the merits of the case and is not expressing any opinion on merits, when the application is pending before the 2nd respondent, it is for the 2nd respondent-Tahsildar to dispose of the application filed by the petitioner, in accordance with law, and pass orders after issuing notice to the affected parties if any.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 21-07-2016 Nvl
