ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/accused seeking to quash the proceedings in Cr.No.350 of 2015 of Falknama Police Station, Hyderabad, registered for the offences punishable under Sections 448 and 506 IPC, against him.

It is alleged in the complaint that the de facto complainant is the registered owner of the property bearing Municipal Nos. 18-8-42/A/A (Part) and H.No.18-8-42/A/B, admeasuring 284 and 237 Sq. yards respectively, total 521 Sq. Yards, situated at Aliabad, Hyderabad, and that on 27.11.2015 at about 4.00 PM., the accused along with some unsocial elements came to the said property and tried to grab the same and also threatened the de facto complainant with dire consequences. Based on the complaint, the aforesaid crime was registered against the petitioner/accused.

In the complaint, some allegations are made against the petitioner and truth or otherwise of the said allegations can be ascertained by the investigating agency during the course of investigation. Therefore, this Court is not inclined to interfere with the impugned proceedings. At this stage, learned counsel for the petitioner/accused confined his argument to the extent that in view of pendency of the above crime, the petitioner apprehends arrest and also harassment in the hands of the police. In view of the same, the police concerned are directed to complete the investigation without arresting the petitioner/accused and file a final report, if any, in accordance with law. The petitioner/accused is directed to produce all the relevant documents establishing that he is the owner of the property in question during investigation and also to appear before the investigating agency as and when required and cooperate with the

investigating agency.

4. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
