This Writ Petition is filed assailing Notice No.2/UC/W.No.118/CIR-14A/WZ/GHMC, dated 09.10.2015, of respondent No.3, whereby he has called upon the petitioners to show cause why the unauthorised constructions made by the latter shall not be removed.

The petitioners pleaded that in response to the said notice, an explanation was submitted by them on 07-12-2015.

However, on an apprehension that respondent No.3 may remove the structures before passing any order on the show cause notice issued to them, the petitioners have filed this Writ Petition.

After hearing the learned Counsel for the petitioners and Mr.Sampath Prabhakar Reddy, learned Standing Counsel for Greater Hyderabad Municipal Corporation (GHMC) appearing for respondent Nos.2 and 3, I am of the opinion that the Writ Petition is wholly misconceived as no order prejudicial to the interests of the petitioners has been passed so far.

Obviously, apprehending action by respondent No.3, the petitioner seeks to preempt further action for removal of the alleged unauthorised constructions as per law. Therefore, I

do not find any merit in this Writ Petition and the same is, accordingly, dismissed.

As a sequel to dismissal of the Writ Petition, WPMP.No.962 of 2016, filed by the petitioners for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 7th January, 2016 lur
