HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 14014 of 2002 ORDER:

This writ petition is filed seeking a writ of mandamus declaring the action of the respondents in not considering the case of the petitioner for appointment as Driver Grade-II, as illegal and arbitrary. Heard Sri A. Bhaskara Chary, learned counsel for the petitioner and Sri P. Durga Prasad, learned standing counsel for the respondents. It has been contended by the petitioner that he was initially appointed as Driver during the year 1996. While he was working as such, the respondents have removed him from service on 04.04.1998 on the ground that the licence possessed by him was fake one.

He submits that he has obtained a fresh driving licence and submitted a representation to the respondents to consider his case for appointment to the post of Driver on the basis of the latest licence obtained by him, but the respondents have not considered the said representation. In those set of circumstances, he has filed the present writ petition. This Court while admitting the writ petition directed the respondents to consider the case of the petitioner vide orders dated 06.08.2002 in WPMP No.17503 of 2002.

In view of the above, this Court is of the considered view that the writ petition can be disposed of directing the respondents to consider the case of the petitioner for engaging him as Driver, if not

already engaged, in accordance with the rules, and pass appropriate orders within four weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 30th October, 2018 cbs
