GANGA RAO Writ Appeal No.1523 of 2017 Judgment: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) Heard Sri M. Saleem, learned counsel for the appellant. This appeal, under Clause 15 of the Letters Patent, is preferred against the proceedings in W.P.M.P. No. 25448 of 2017 in W.P. No. 20739 of 2017 dated 27.6.2017.
The proceedings dated 27.6.2017 is only for a notice to be issued by registered post with acknowledgment due; and for the matter to be posted after six weeks.
As has been held by a Division Bench of this Court, in Kunala Subbarao vs. P.Nagaratnayamma1, an appeal under Clause 15 of the Letters Patent, does not lie against the action of the learned Single Judge in merely deferring the hearing of the Writ Petition. We see no reason, therefore, to entertain this appeal under Clause 15 of the Letters Patent.
The Writ Appeal fails and is, accordingly, dismissed.
Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
