HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.25734 of 2015 ORDER:

Heard Sri D. Balakishna Rao, learned counsel appearing for the petitioner and Dr. K. Lakshmi Narasimha, learned standing counsel for the respondents.

2. The petitioner was appointed as a clerk-cum-cashier in the 1st respondent-Bank on 11.08.1986. While he was working as such, the 2nd respondent issued letter dated 11.04.2000 placing the petitioner under suspension and a charge memo dated 03.07.2000 was also issued framing certain charges against him. Thereafter, an enquiry was conducted against the petitioner and ultimately, he was dismissed from serviced in the year 2001. Consequent on the dismissal of the petitioner from service, the bank paid gratuity amount by duly deducting loss of Rs.35,205/- vide letter dated 20.02.2002 and also paid the provident fund amount of Rs.61,168/- on 07.01.2002 to the petitioner.

The grievance of the petitioner is that on the date of dismissal he had 286 days of earned leave and 12 days of casual leave to his credit and as per the Rules of the Bank, he is entitled to encash the said leaves, but the respondent-bank has not responded to his request. The petitioner also made several requests and representations, last one is on 24.03.2014 requesting the Bank to pay the 7th Bipartriate settlement arrears and also the amount relating to encashment of leave and the said representation is pending with the respondents.

3. Under these circumstances, the writ petition is disposed of directing the respondents to dispose of the representation dated 24.03.2014 submitted by the petitioner, and pass appropriate orders thereon, in accordance with the Rules, within a period of eight (8)

weeks from the date of receipt of a copy of this order. Miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs.
