Gaddam Shankaraiah, v. State Of Andhra Pradesh,
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.36312 of 2017 ORDER :
Heard the counsel for petitioner, and the learned Government Pleader for Revenue, for respondents.
2.
This Writ Petition has been filed by petitioner herein assailing notice dt.30.09.2017 (for short, 'the impugned notice'), issued by the 4th respondent under the provisions of Rule 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 2007 alleging that petitioner had contravened Section 3(2) of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977. 3.
In the said impugned notice, it is mentioned that petitioner transferred his assigned land to one Akula Dileep in Column No.5, but in Column No.6, where the 4th respondent has to mention about the nature of transfer, no details are furnished. 4.
Since the impugned notice is vague for the said reason, no action on that basis can be taken by the 4th respondent. 5.
Therefore, the impugned notice is set aside, and the 4th respondent is granted liberty to issue fresh notice provided it contains all the details as are statutorily required including details to be mentioned in Column no.6 of the Form-I notice.

6.
The 4th respondent shall also furnish copy of the transfer deed which he alleges that the petitioner executed in favour of Akula Dileep.
7.
Any vehicles of petitioner seized pursuant to the impugned Form-I notice shall be forthwith released by 4th respondent. 8.
Accordingly, the Writ Petition is allowed. No order as to costs. 9.
As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
