HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39486 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents 2 and 3 in not initiating appropriate action for removal of the illegal ramp constructed by the fourth respondent at H.No.29-22-25, Pisapativari Street, Suryaraopet, Vijayawada, for her private use by occupying 25% of the thickly trafficked public road, as illegal and arbitrary.
2) Pursuant to the notice issued, the learned Standing Counsel for the second respondent-Corporation placed on record the report which indicates that the ramp was removed permanently on 12.11.2018 and the photographs filed along with the report also indicate the same.
3) The learned counsel appearing for the fourth respondent stated across the Bar that subsequent to filing of the writ petition the ramp was removed.
4) Having regard to the above, this Court is of the view that there nothing survives for adjudication in the writ petition at this stage. Accordingly, the Writ Petition is disposed of with a direction to the fourth respondent not to make any illegal constructions.
5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
