HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No. 28908 of 2014 ORDER:

Heard the learned counsel for the petitioners. 2.

The prayer of the writ petition is as under:

" For the reasons stated in the accompanying affidavit, it is hereby prayed that this Court may be pleased to issue any appropriate writ, order or direction more particularly in the nature of writ of mandamus, declaring the action of the 6th and 7th respondents in interfering into the civil disputes and detained the petitioners illegally at the Police Station and threatened them with dire consequences and lodged the FIR No 58 of 2014 on the file of the 6th respondent Police Station without conducting fair enquiry and the action of the 8th respondent in not surveying the land to an extent of Ac0 85 cents in S Nos 105/ A1 / Al/ A 105/ A2/ A1/ A and 105 B situated at Machavaram Village Mandal Guntur District as per the Transaction I D TADER011400030851 dated 07 03 2014 and intentionally acting unilaterally by colluding with the other rivalry groups in the village is illegal arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently quash the FIR No 58 of 2014 on the file of the 6th respondent Police Station by directing the 3rd respondent to initiate departmental proceedings against the 6th and 7th respondents in accordance with law and pass any other order or orders as this Court may deems fit and proper in the circumstances of the case."

During the course of arguments, the learned Government Pleader for Home appearing for the respondents 1 to 6 placed the written instructions dated 09.10.2014 issued by the Assistant SubInspector of Police, Machavaram Police Station, Guntur District on record. On the complaint of 10th respondent, on 09.08.2014 a case in Crime No.58 of 2014 under Sections 448, 434, 506 r/ w 34 IPC came to be registered against the petitioner and others. Except the registration of the said crime, the respondents-police have nothing to do with the civil disputes between the petitioners and the 10th respondent.

In the light of the said statement, this Court is of the opinion that no further orders are required in the writ petition. Accordingly, the writ petition is closed. There shall be no order as to costs.
