THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7619 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-A1 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail to him in N.S.C. No.68 of 2014 on the file of metropolitan Sessions Judge-cum-Special Judge to try offences under NDPS Act, Visakhapatnam, for the offence punishable under Section 20 (b) of the NDPS Act.

The case of the prosecution is that the petitioner was caught hold by the police on 02.05.2013 while he along with other accused was carrying ganja illegally, and was remanded to judicial custody in connection with Crime No.22 of 2013. Subsequently, the petitioner was released on bail. Thereafter, the petitioner was taken into custody on 04.07.2015 and was detained in Central Prison, Visakhapatnam, under Preventive Detention Act and the same was challenged by the petitioner before this Court in WP No.27858 of 2015 and this Court vide orders, dated 09.12.2015, disposed of the said writ petition by setting aside the detention order and directing release of the petitioner. Thereafter, the petitioner was implicated in another crime i.e. Crime No.24 of 2015 and was arrested.

Therefore, the trial Judge issued PT warrant for his attendance in connection with above case i.e. NSC No.68 of 2014. Hence, the petitioner approached this Court. Heard and perused the material available on record. Considering the facts and circumstances of the case, this Court is not inclined to pass any order in this application. However, the petitioner is at liberty to approach the Court concerned for appropriate relief.

Accordingly, The criminal petition is disposed of.

Miscellaneous petitions, if any, shall stand closed.
