THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.36146 of 2017 ORDER:

Heard counsel for petitioner and the Government Pleader for Revenue appearing for respondents 1 to 5. 2.

Petitioner had filed this Writ Petition assailing the order dt.26.08.2017of the 2nd respondent dismissing the petitioner's Revision under Section 9 of the A.P. Rights in Land and Pattadar Passbook Act, 1971.

Petitioner had filed O.S.No.169 of 2006 before the Senior Civil Judge, Nizamabad for partition of the properties between himself and his brothers.

The said suit was dismissed on 07.08.2012.

A.S.No.907 of 2012 filed against the judgment and decree in the said suit is pending before this Court. 6.

Therefore, pending disposal of the said appeal, the revenue authorities cannot be said to have committed any error in not including the petitioner's name in the revenue records. Unless the petitioner succeeds in the appeal, his name cannot be included in the revenue records. Therefore, I see no error in the order passed by the 2nd respondent.

Accordingly, the Writ Petition is dismissed at the stage of admission. No costs.

Miscellaneous petitions, pending if any, shall stand closed.
