THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40776 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the fourth respondent in interfering in civil matters as illegal and arbitrary, and consequently direct the fourth respondent not to interfere in civil matters and not to call the petitioner to the police station. Heard and perused the material.

Learned counsel for the petitioner submits that the fourth respondent is interfering in the civil matters of the petitioner and is calling the petitioner to the police station. He further submits that there are civil disputes between the petitioner and the fifth respondent, and at the instance of the fifth respondent, the fourth respondent is calling the petitioner to police station and compelling him to settle the matter with the fifth respondent. Hence, he prays this Court to direct the fourth respondent not to interfere in the civil matters of the petitioner. Learned Assistant Government Pleader for Home (Telangana) submits that the fourth respondent is not interfering with the affairs of the petitioner.

Considering the rival submissions of the learned counsel for the petitioner and the Assistant Government Pleader for Home (Telangana), and also considering the facts and circumstances of the case, the fourth respondent is directed not to interfere with the affairs of the petitioner and also not to call the petitioner to the police station. The fourth respondent is also directed to follow due process of law laid down in Code of Criminal Procedure. The writ petition is accordingly disposed of.
