Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for respondents. 2.
Petitioners have filed this Writ Petition challenging the order dt.09-10-2017 of 2nd respondent rejecting stay application filed by the petitioners without assigning any reason. 3.
The said order passed by 2nd respondent reads: "On perusal of documents, it seems that there is no need of grant stay in the case. Hence the stay petition is not considered." Shocked with this callousness of 2nd respondent, on 25-10-2017, my learned brother Justice P.Naveen Rao directed 2nd respondent to appear before this Court on 06-11-2017.

Today, 2nd respondent has appeared.

Learned Government Pleader for Revenue states that this is the first time mistake occurred on the part of 2nd respondent and the same may be excused.

This Court is coming across similar acts of casualness on the part of the statutory authorities day in and day out. The 2nd respondent does not seem to be aware of the fundamental principle that the reasons ought to be given, however briefly, on rejecting applications for stay. Therefore, the order dt.09-10-2017 in statutory
MSR,J W.P.No.35214 of 2017 appeal No.B/1464/2017 of 2nd respondent is set aside and matter is remitted back to 2nd respondent to reconsider the matter and pass a reasoned order. The 2nd respondent shall also pay costs of Rs.5,000/- (Rupees Five Thousand only) to the High Court Legal Services Committee, High Court Buildings, Hyderabad, within two weeks from today.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
