THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2599 OF 2015 ORDER:

This criminal revision case under Sections 397 and 401 of the Code of Criminal Procedure is filed by the petitioner/A.6 seeking to set aside the docket order, dated 30.10.2015 passed in Crl.M.P.No.195 of 2015 in C.C.No.2 of 2003 on the file of the Court of the II Additional Judicial Magistrate of First Class, Kakinada, East Godavari District, whereby the learned Judge dismissed the petition filed by the petitioner seeking to recall the Non Bailable Warrant (NBW) issued against the petitioner. Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner/accused is a law abiding citizen and he is ready to face the trial and as such, prays this Court to recall the NBW issued against the petitioner/A.6.

In view of the facts and circumstances, the petitioner/A.6 is directed to appear before the Court below and file an application for recalling NBW issued against him on or before 30.11.2015, and on filing of such application, the Court below is directed to recall the NBW issued against the petitioner/A.6 on the same day on condition of the petitioner executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with one surety for the like sum to the satisfaction of the said Magistrate. The petitioner is directed to appear before the Court below on all hearing dates.

The Criminal Revision Case is accordingly disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 04.11.2015 pln
