O R D E R

This criminal petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking enlargement on bail in connection with Crime No.355 of 2025 of Kothur Police Station, Cyberabad Commissionerate. The offence alleged against the petitioner is under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023 (BNS). 2.

The brief facts of the case are that, on 11.11.2025, the de-facto complainant lodged a report with the police stating that the petitioner herein and deceased are co-brothers and they used to quarrel in the work place and on the date of incident, he observed a boulder (Ganate

- 2 - Stone) in Kitchen, and found the deceased was bleeding from mouth and dead and he informed the same to the builder and later, when he tried to inform the same to the petitioner, the petitioner was not found in the said place and when he asked his wife, she also stated that she don't know about her husband and he suspected the petitioner is responsible for the death of the deceased. As such, the complainant prayed for necessary action. Based on the complaint, the police registered a case for the aforementioned offences. 3.

Heard Sri Syed Osman, learned counsel appearing for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of the learned counsel for the petitioner is that the petitioner is innocent of the said allegations and expect suspicion there is no eye witness to the incident to show that the petitioner is responsible for the death of the deceased. He further submitted that the petitioner has been in judicial custody since 12.11.2025, and the material part of the investigation has already been completed and he is the only bread earner of his family. Hence, he prayed this Court to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are serious in nature and the investigation is not yet completed and he is

- 3 - the resident of Chhattisgarh, therefore, he is not entitled for the bail. Hence, he prayed the Court to dismiss the criminal petition. 6.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it is noted that the petitioner has been in judicial custody since 12.11.2025. As per the remand case diary, prosecution witnesses L.Ws.1 to 16, including the investigating officer, have already been examined and as on today, no charge sheet is filed, according to the prosecution. Considering the facts, stage of investigation, and period of incarceration, this Court finds it appropriate to grant bail to the petitioner/Accused, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Principal Judicial First Class Magistrate, at Shadnagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

(presently, Section 480(3) of the BNSS).
