THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36673 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of the respondents in interfering with the petitioner's possession and construction in house plot bearing No.1-1-380/18/A (New) 1-1-380/18 (Old) situated at New Bakaram, Gandhinagar, Hyderabad as illegal and arbitrary and consequently, to direct the respondents not to interfere in petitioner's possession and construction in the said house plot. 2.

Heard and perused the material available on record. 3.

Learned Assistant Government Pleader for Home denied the entire allegations and submitted that respondent No.3 will not interfere in the petitioner's possession and construction in the aforesaid house plot.

Considering the facts and circumstances of the case, this Court is of the view that the writ petition can be disposed of with the following direction:

Respondent No.3 is hereby directed not to interfere in the petitioner's possession and construction in the house plot bearing No.1-1-380/18/A (new) 1-1-380/18 (old) situated at New Bakaram, Gandhinagar, Hyderabad. At the same time, the present order will not stand in the way of respondent No.3 to proceed with the investigation if any complaint is registered against the petitioner for a cognizable offence.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
