THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11638 OF 2018 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused, for grant of bail in Crime No.300 of 2018 of Bandar Taluk, Krishna District, registered for the offence punishable under Section 304-II of IPC.

Heard the learned counsel for the petitioner/accused and the learned Additional Public Prosecutor representing the respondent-State and perused the record.

The learned counsel for the petitioner/accused would submit that the petitioner/accused has nothing to do with the death of the deceased, viz., Jonnala Venkanna. A false report was lodged against the petitioner/accused stating that he is responsible for erection of electrical wire at his field and ultimately, prayed to allow the petition.

The learned Additional Public Prosecutor opposed the grant of bail to the petitioner/accused.

As per the investigation conducted by the police, the petitioner/accused illegally connected live electrical wires to the electrical poles and responsible for the death of the deceased. Therefore, it cannot be said that the petitioner/accused is an innocent person and was not responsible for the death of the deceased. The allegations are specific and grave. The matter requires thorough investigation. The punishment for the alleged offence is stringent. The release of petitioner wound hinder the investigation. The petitioner is not entitled for bail under Section 438 Cr.P.C.

In the result, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
