THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.825 of 2016 ORDER:
This Criminal Revision Case, under Sections 397 and 401 of Code of Criminal Procedure, 1973 is directed against order, dated 06.01.2016, in Crl.M.P.No.560 of 2013 in M.C.No.111 of 2013 on the file of XV Additional District Judge, Ranga Reddy District, L.B.Nagar, wherein and whereunder, Miscellaneous Petition filed under Section 125 Cr.P.C., for grant of interim maintenance of Rs.30,000/- per month to petitioners herein was allowed in part awarding interim maintenance of Rs.8,000/- per month to each of the petitioners herein. Aggrieved by the said order, the petitioners herein filed the present revision case seeking enhancement of interim maintenance.
2. At the time when the matter is taken up for hearing, learned counsel for the petitioner, fairly stated that the 2nd respondent herein filed Crl.P.No.3670 of 2016 questioning the very same order and this Court by an order, dated 17.03.2016, disposed of the Criminal Petition reducing the quantum of maintenance from Rs.8,000/- per month to Rs.4,000/- per month to each of the petitioners herein. It appears that the said order has become final. In view of order passed by this Court in Crl.P.No.3670 of 2016, the question of enhancement of maintenance would not arise.
3. Having regard to the facts and circumstances stated above, the Criminal Revision Case is disposed of directing the trial Court to dispose of M.C.No.111 of 2013 on the file of XV Additional District Judge, Ranga Reddy District, L.B.Nagar, as early as possible, preferably within six (6) months from the date of receipt of a copy of this order, uninfluenced by the observations made in this order.
4. Miscellaneous petitions, if any, pending in this revision case shall stand closed.
