HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.14189 OF 2015 ORDER:
This Writ Petition is filed by the petitioner seeking to issue a writ of mandamus to declare the action of the respondents 2 to 4 in not taking action on the representation, dated 25.02.2015, submitted by the petitioner and not cancelling the registered partition deed vide document No.6020/2014, dated 23.07.2014, registered sale deed No.8163/2014, dated 29.09.2014 and registered partition deed No.7961, dated 29.09.2014, as illegal and arbitrary, and consequently direct respondents 2 to 4 to cancel the above documents, registered in the office of Joint Sub-Registrar-II, Tadepalligudem, West Godavari District. The relief sought for by the petitioner is to cancel the sale deed and also partition deeds. Hence, the writ petition cannot be entertained for deciding the civil disputes, which involve disputed questions of fact.
The writ petition is bereft of merits and accordingly, the same is dismissed. However, it is left open to the petitioner to avail the remedies available to him under law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
