The averments made in the affidavit filed in support of the writ petition would disclose that the Nagara Sanga Chalak Rastriya Svyam Sevak, of Karimnagar Unit proposed to conduct closing ceremony of "Sarvajaneekotsavam" on 05.11.2017 which would involve congregation of 3000 delegates from all over the State and prominent leaders from all over the Country. They proposed to conduct such programme in the circus ground in Karimnagar and an application was made for granting permission. By order dated 21.10.2017, the Revenue Divisional Officer, Karimnagar also the Secretary of Exhibition Society rejected the said application on the ground that the District Collector and Chairman of Exhibition Society, considered the request of the Manager of State Handloom & Handicraft Expo, Warangal, to conduct Handloom and Handicraft exhibition-cum-sale expo from 23.10.2017 to 12.11.2017, i.e., for a period of 21 days, and allotted the very same ground and as the proposed closing ceremony is falling between these two dates i.e., 05.11.2017, therefore permission cannot be granted.

Petitioner challenges this proceeding contending that if the authorities were of the opinion that the permission could not have been granted, they could have rejected the application at the initial stage itself and could not have received the application with application fee. He further submits that as the application was made with a fond hope of getting such permission, pamphlets were

- 3 - already printed and distributed indicating the place of event and since this place is not granted now great prejudice would be caused to the organizers.

What is contended by learned counsel for the petitioner may be true, however, from the facts noted above, it is clear that the expo was for a period of 21 days and the date on which the proposed ceremony is to be conducted is falling between the two dates i.e., 23.10.2017 to 12.11.2017 and the closing ceremony is only for one day as against conducting of expo for 21 days. 5.

Having regard to these facts, it cannot be said that the decision of the Revenue Divisional Officer, impugned in this writ petition is vitiated as amounting to arbitrary exercise of power. 6.

Thus, the relief prayed in this writ petition cannot be granted.

At this stage, learned counsel for the petitioner fairly submits that the Organizers of Nagara Sanga Chalak Rastriya Svyam Sevak, Karimnagar would request the District Collector for any other alternative site and such request shall be considered by the District Collector.

Having regard to the programme proposed to be conducted on 05.11.2017, it is open to the petitioner/Organizers of Nagara Sanga Chalak Rastriya Svyam Sevak, of Karimnagar, to submit an application to the District Collector to allot any other place and if such an application is made, the District Collector shall consider the same objectively and take a decision.

Having regard to the schedule already fixed, the District Collector, Karimnagar, is directed to take decision within three (3) days from the date of submission of application by the petitioner. 10.

With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
