THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.459 OF 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused under Section 438 Cr.P.C. seeking to grant anticipatory bail in Crime No.6 of 2016 on the file of I-Town Police Station, Narasaropet, Guntur District, registered for the offences punishable under Sections 323 IPC and 3

(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (for short 'the Act').

Heard and perused the material available on record. The allegation against the petitioner is that he abused the de facto complainant in the name of his caste, when the de facto complainant came to his office and asked about the land since the land, which the de facto complainant purchased, was registered in the name of the wife of the petitioner.

A reading of the complaint discloses that there are civil disputes between the parties. Though the allegations in the complaint are not so serious in nature, there is a bar for grant of anticipatory bail under the provisions of the Act. Hence, this Court is inclined to pass the following order:

The petitioner is directed to surrender before the Court concerned and file an application for grant bail. On such application being filed, the Court concerned is directed to consider the same on the same day.
