This writ petition is filed challenging the order of the Court below in OP.No.5 of 2013, dated 09-09-2015, wherein the Court below has declared election of the petitioner as Sarpanch as void and directing fresh election to be held. Both the counsel say that the matter has to be remanded back to the Court below as WPMP.No.12151 of 2017 to receive date of birth certificate dated 07-05-2013 issued by Registrar of Births and Deaths, Nagar Panchayat, Huzurabad, Karimnagar District was allowed and that OP is to be decided afresh.

In view of the same, the impugned order is set aside and the matter is remanded back to the Court below and the Court below is directed to consider the certificate dated 07-05-2013 issued by the Registrar of Births and Deaths, Nagar Panchayat, Huzurabad, Karimnagar District along with other documents and decide the matter afresh after giving opportunity to the petitioner.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
