HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 9 7 6 9 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Divisional Police Officer/ IO., West SubDivn., Guntur Urban District, dated 27.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that basing on the complaint of the petitioner, a case in Cr.No.76/ 2017, dated 05.03.2017, under Sections 420, 468, 471 and 506 r/ w 34 I.P.C., was registered on the file of the 4th respondent Police Station, against one Kurri Ramanjaneya Reddy and 4 others.

It is submitted that Kurri Brahmananda Reddy, A.3 in Cr.No.76/ 2017 has filed W.P.Nos.3788 and 13064 of 2017, the then Inspector of Police, Pattabhipuram P.S., alleging harassment at the instance of the husband of the petitioner herein and to quash Cr.No.76/ 2018, which were disposed of by common Orders, dated 18.04.2017. Pursuant to which, the SDPO, West, Guntur Urban, has taken up investigation, as per the Orders of the Superintendent of Police, Guntur Urban.

It is submitted that during the course of investigation, the Investigating Officer has examined (7) witnesses and recorded their statements.

Further, the Investigating Officer has filed Memo. On 24.11.2018, on behalf of the prosecution before the Hon'ble III-Additional District Judge, Guntur in O.S.No.82/ 2017, wherein the Investigating Officer in Cr.No.76/ 2017 was prayed to issue original sale agreement, dated 09.05.2016, which was filed by

the accused in Cr.No.76/ 2017 and the plaintiff in O.S.No.82/ 2017 which was purported to be executed by the writ petitioner for sending the same to Forensic Science Laboratory, Hyderabad, for the opinion of Handwriting Expert and to elicit the truth and also to probe further in this case and it is pending consideration by the Hon'ble III-Adl District Judge, Tunru.

It is submitted that after receipt of the analysis report from the FSL, Hyderabad, the SDPO/ IO will proceed with the further investigation in Cr.No.76/ 2017 of Pattabhipuram P.S., and will complete the investigation as expeditiously as possible and thereon will file a final report under Section Cr.P.C.

before the concerned jurisdictional Court, without any delay.

In view of the facts and circumstances stated above, all the contentions of the petitioner about non-conducting of investigation in Cr.No.76/ 2017 is not correct and hereby denied."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Divisional Police Officer/ IO, West Sub-Division, Guntur Urban District, dated 27.11.2018, with a direction to the respondent-Police authorities to complete the investigation, as expeditiously as possible.
