HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39644 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 2nd respondent in issuing the notice dated 14.9.2018 by seizing the vehicle bearing No.AP 27 TW 5430, as illegal and arbitrary.
When the matter is taken up for hearing, the learned Government Pleader for Prohibition and Excise, would submit that as the confiscation order came to be passed on 24.10.2018 by the 2nd respondent, the question of release of the subject vehicle, pending the proceedings, does not arise.
Having regard to the above, the writ petition is dismissed giving liberty to the petitioner to challenge the confiscation order dated 24.10.2018 of the 2nd respondent by filing an appeal before the competent authority, in which event, the concerned authority shall deal with the same and pass appropriate orders, in accordance with law. No order as to costs.
