THE HONOURABLE MR JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.5153 of 2015

ORDER

Heard learned counsel for the petitioner and learned Government Pleader for Home.

2. The grievance of the petitioner is that in spite of his complaint dated 14.01.2015, no action is taken by the Station House Officer, respondent No.3 herein, against the unofficial respondents though a cognizable offence is made out in his complaint.

3. The instructions of learned Government Pleader for Home show that the complaint of the petitioner was received through post on 18.01.2015, and for a preliminary enquiry and for verifying the authentication of the complaint, petitioner's presence is necessary, but he has not visited the third respondent Police Station. It is also stated in the instructions that two writ petitions, namely, W.P.Nos.8874 of 2012 and 40366 of 2014 and one appeal being W.A.No.111 of 2015, appear to have bearing on the subject matter of the present writ petition. In addition to that, there also appears to be a civil suit being O.S.No.302 of 2006 before the Senior Civil Judge's Court, Kadapa and C.M.A.No.2 of 2007 before the Family Court-cum-Additional District Judge, Kadapa. In order to appreciate all the pending proceedings and the complaint of the petitioner, the presence of the petitioner is necessary, so that the Station House Officer, after preliminary enquiry, would take appropriate steps with regard to the complaint of the petitioner.

4. In view of that, therefore, the learned counsel for the petitioner states that the petitioner will appear before the third respondent and explain all the facts in regard. The petitioner, therefore, is at liberty to approach the third respondent,

who shall examine the matter and record his statement and then take further steps in the matter.

5. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
