HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 9 6 0 7 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Ongole Taluka Police Station, Prakasam District, dated 08.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that basing on the complaint of the petitioner herein, a case in Cr.No.497/ 2017, dated 24.10.2017, under Sections 448, 420, 464, 468 and 120-B of I.P.C., and Section 5 of the A.P.Land Grabbing (Prohibition) Act, 1982, was registered on the file of the Ongole Taluka Police Station, against the respondents 5 to 15 herein, wherein investigation was taken up by the SubInspector of Police, Ongole Taluka Police Station.

It is submitted that during the course of investigation, the Investigating Officer has so far examined (5) witnesses and recorded their statements. Further, after issuing notice under Section Cr.P.C., to the accused, obtain documents relating to the crime for the purpose of investigation. Apart from that, the Investigating Officer has also obtained relevant information from the Divisional Cooperative Officer, Ongole, on 23.03.2018. Further, the Investigating Officer has also sought for certain information from the Revenue Divisional Officer, Ongole, vide letter 20.03.2018 and also issued reminder letter, dt.25.10.2018, the same is yet to be received from the RDO, Ongole.

some more witnesses, the investigation will be finalized in Cr.No.497/ 2017, dt.24.10.2017, as expeditiously as possible and final report under Section Cr.P.C., will be filed before the concerned jurisdictional Court without any delay. In view of the facts and circumstances stated supra, the allegation of the petitioner that investigation is not being conducted in Cr.No.497/ 17, dt.24.10.2017, by the respondent police authorities and the same is being kept in cold storage etc., is false and baseless. All other allegations of the petitioner against the respondent police authorities in the Writ Petition are incorrect, untenable and hereby denied."

Having regard to the contents of the above instructions, the Writ Petition stands disposed of, with a direction to the respondents herein to complete the investigation, as expeditiously as possible, strictly in accordance with law.
