HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.6801 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies for the State of A.P.

2. This writ petition is filed seeking Writ of Mandamus declaring the action of the 2nd respondent in with-holding the issuance of order of appointment as the Fair Price Shop dealer of Thonduru Village & Mandal, YSR Kadapa District even after selection of the petitioner on the pretext of receipt of a complaint and issuing the endorsement dated 16.02.2015 the contents whereof were denied through the reply dated 18.02.2015 of the petitioner and not passing any orders on the same even though more than three weeks have been lapsed, as illegal and arbitrary.

3. Admittedly, pursuant to the notification issued by the respondents, the petitioner appeared for the test of Fair Price shop dealer and he was one of the selected candidates. Subsequently, it seems that one Sivamohan Reddy, who is said to be enimically disposed of towards the petitioner, submitted a petition to the respondents making certain allegations. Basing on the said petition, it seems that issuance of authorisation of the petitioner is kept in abeyance by the authorities. Learned counsel appearing for the petitioner submits that the allegations levelled against the petitioner are absolutely false and baseless.

4. Under the above circumstances, the respondents are directed to make an enquiry in to the allegations levelled against the petitioner and pass appropriate orders on the representation of the petitioner, within a period of four weeks from the date of receipt of a copy of this order.

5. The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
